THE J-CLUB TERMS & CONDITIONS

1. Interpretation and Variation
1.1. These are the Terms and Conditions of Membership ("T&Cs") between The J-Club (“Club”), a subsidy of Jumeirah Group (“Hotel”) and each member of The J-Club (“Member”). These T&Cs replace any existing terms and conditions governing a member’s membership of the Club.
1.2. The Hotel reserves the right to add to, alter or revoke these T&Cs from time to time. Any such changes will be notified to members and, until revoked, are binding on members.
1.3. These T&Cs shall be governed by the laws of the Emirate of Dubai, the United Arab Emirates.

2. Membership
2.1. The acceptance of a membership or day guest access is at the sole discretion of the management of the Club (“Management”) and the Management reserves the right to refuse membership at any time without any explanation or reason.
2.2. Members are advised they are obliged to read the rules and regulations on joining the Club and that by activating a membership they have agreed and accepted to the T&Cs.
2.3. The Hotel/Management reserves the right to terminate any membership for breach of the rules, or conduct which in the Hotel/Management’s sole discretion, is damaging to the character or interests of the Club or offensive to other members or staff of the Club/Hotel.
2.4. The use of a membership card by any person other than the member will result in the cancellation of membership and forfeiture of fees.
2.5. Members are advised to carry their membership access pass with them when entering the Hotel and present it to enter the Club. Failure to produce a valid membership card may result in refusal of entry. Membership access passes are only valid for the holder of the Membership and are not transferable. Pets are not allowed into the Club at any time.
2.6. Care givers such as ‘Nannies’ must be registered for the price of an additional child or pay the daily rate of a member’s guest.
2.7. Club management reserves the right to review and change membership fees, discounts and benefits at its discretion. Any changes to fees will be communicated to the primary member with at least 30 days’ notice.

3. Acceptance & Commencement of Membership
3.1. Acceptance of an application for membership is at the absolute discretion of the Hotel.
3.2. Subject to clause 3.1, when an applicant has signed the T&Cs and the Hotel has received a signed membership agreement, the applicant shall become a member of the Club.
3.3. Failure to use the Club(s) or non-usage of the Club’s facilities does not eliminate your obligation to pay all the Membership Fees promptly as per these Terms and Conditions.
3.4. Payment of the Membership Fee entitles you to the use of the Club facilities during Club opening hours, in accordance with your membership type.

4. Membership Suspension
4.1. In the event that a Member suffers serious illness, serious injury or becomes pregnant, the Membership may be suspended for a minimum of one (1) month, whereby no charge will be made by the Club during the period the membership is suspended. The Club reserves the right to request documentary medical evidence of the serious illness, serious injury or pregnancy if deemed necessary.
4.2. Provided that all fees have been paid-up-to-date, a membership may be suspended for any other reason (other than those set out in clause 4.1 above) for a minimum of one (1) month and a maximum of three (3) months. The first freeze request is complimentary, and any subsequent free requests will incur an administration fee of AED 250.
4.3. To apply for a suspension in accordance with clauses 4.1 and 4.2, the Member must do this in writing to the attention of Club Management via email membership@thejclub.com, giving no less than 30 days’ notice of the date upon which you wish your membership to be suspended. The period of suspension must be for 30 consecutive days, and not for any lesser period.
4.4. All Membership benefits associated to the membership type will be frozen during the agreed suspension period.

5. Cancellation
5.1. A member may cancel their membership at any time by written request to the Club Management, by giving one (1) full calendar months’ notice of the desired cancellation date upon expiry of at least two (2) full calendar months of membership. If a member wishes to cancel membership after three (3) months of membership he may do so by giving one (1) full calendar months’ notice. Cancellation will only be accepted if the Management has received a member's written notification within the required notice period.
5.2. Pre-paid annual memberships are non-refundable and will automatically expire after the contract term duration paid for.
5.3. Where a member has outstanding sums due to the Club he/she will not be permitted to re-join or reinstate membership until all such outstanding sums are settled.
5.4. The Hotel and/or Club Management reserves the right to expel from the Club, suspend for a specific period or refuse to renew the membership of any member whose conduct is or may, in the Management’s sole opinion, be injurious to the character of the Club or amounts to a breach of these T&Cs or where such expulsion is otherwise in the interests of the other members of the Club. Any member so expelled shall forfeit all privileges to Club membership and shall not be entitled to any pro-rata payment of the Annual Payment for any period during which membership is suspended.
5.5. The Management reserves the right to terminate any Club membership with one (1) months’ notice and refund any unused portion of prepaid annual membership on a pro-rata basis.

6. Limitation of Liability
6.1. The Hotel and Club cannot be held responsible for any service or equipment not being available for whatever reason. The Hotel and Club reserves the right to make alterations to the type of facilities provided, without notice and
 in its absolute discretion and shall not be liable for any loss occasioned by such alterations except in so far as such loss is by law incapable of exclusion.
6.2. It is the member’s responsibility to ensure that he/she is in good physical condition and capable of undergoing a routine of exercises provided by any programme which he/she follows or class which he/she attends. Members are advised to consult their doctor prior to beginning any programme or class.
6.3. The Hotel accepts no liability for loss or damage to property or cars of members or guests on the Club premises or in the car park. Cars are left in the car park solely at the owner’s risk.
6.4. Members who are pregnant are advised to consult a physician prior to engaging or continuing any form of physical activity.
6.5. If for whatever reason the Hotel/Club is forced to close due to reasons outside of their control, the Member’s membership will be frozen. Prepaid annual Members will have their membership term extended for the duration of time in which the Club was closed. Monthly paying Members will have their membership frozen and their monthly membership rate will not be taken until the Club can reopen.

7. Membership Access
7.1. Upon acceptance the member will be issued with a membership access card or wristband which shall remain the property of the Club and the member shall be entitled to all benefits and discounts associated to the type of membership purchased.
7.2. The loss of a membership card/ RFID wristband must be reported to the Club so that a replacement can be issued. The Member will incur a charge of AED 100 to replace it. Lost membership cards/RFID wristbands will be deactivated once reported by the Member.
7.3. For health and safety purposes, Members are required to produce their membership cards at any given access control point throughout the Club facility. Failure to do may result in refused admission to the Club.
7.4. Only members and guests of members or hotel can use the Club facilities.

8. Guests of Members
8.1. Members are solely responsible for the actions and conduct of their guests at all times and must ensure that guests comply with these T&Cs including any local rules or regulations of the Club.
8.2. Guests of Members will be admitted at the absolute discretion of the Management. Each Membership, whether a single or any other type, shall be allowed a maximum of four (4) guests per day.
8.3. An admission fee for a member’s guest is charged and payable on entry to the Club for each adult and Child (2-15 years old considered as a child). Payment of the admission fee will be the responsibility of the member who authorises the guest to attend the Club.
8.4. Members must accompany their guests into the Club. The guest will only be permitted to stay in the Club whilst the member is present.

9. General
9.1. The Hotel may accept or refuse any membership application or renewal without explanation or reason.
9.2. Members or hotel / member guests may not use the facilities whilst under the influence of alcohol, narcotics or other mood altering substances.
9.3. The Club operates a strict no smoking policy inside the Club premises.

10. Food & Beverage
10.1. Under no circumstances may food and beverage be brought into the Club from outside the Hotel.
10.2. Membership type ‘Lifestyle’ Members are entitled to twenty percent (20%) discount on food and beverage outlets for up to six (6) guests. This benefit is valid seven (7) days a week upon production of a valid membership card in any of the restaurants and bars at the Hotel (please note that the discount for up to six (6) people is available per membership, not per membership card and does not apply to any guests of a member, special promotions or banquet functions).
10.3. Membership type ‘Sports & Fitness’ Members are entitled to ten percent (10%) discount on food and beverage outlets for up to six (6) guests. This benefit is valid seven (7) days a week upon production of a valid membership card in any of the restaurants and bars at the Hotel (please note that the discount for up to six (6) people is available per membership, not per membership card and does not apply to any guests of a member, special promotions or banquet functions).
10.4. Membership type ‘Fitness Members’ are entitled to ten percent (10%) discount on food and beverage outlets for up to six (6) guests. This benefit is valid seven (7) days a week upon production of a valid membership card in any of the restaurants and bars at the Hotel (please note that the discount for up to six (6) people is available per membership, not per membership card and does not apply to any guests of a member, special promotions or banquet functions).
10.5. Please note the members’ discount does not apply to any of the children’s menus as these menus are already discounted by fifty percent (50%) on the regular price. Your membership card must be shown in order to avail the discount at the time of ordering. (2-15 years old is considered as child).

11. Restrictions
11.1. Games or activities which are disturbing or dangerous such as bikes, skate board and skates are not permitted.
11.2. Media playing devices such as iPods, Smartphones, Tablets, and PCs must be used responsibly and with any sound played through headphones only.
11.3. The member shall not use any Hotel or Club facilities whilst suffering from any infections or contagious illness, disease or other ailment such as open cuts, abrasions, open sores or minor infection, where there is a risk that such use may be detrimental to the health, safety, comfort or physical condition of other members.

12. Data Protection
12.1. The Hotel will comply with the Data Protection Act 1998. The Hotel warrants that, to the extent it processes any Personal Data (having the meaning given to it by the Act mentioned) on each member’s behalf:
 (a) Personal Data may be transferred to third parties in accordance with these T&Cs. The Hotel shall require such third parties to process Personal Data fairly and lawfully in accordance with the principles of the Act.
 (b) Every member is entitled to see the information held about them and may ask the Hotel to make any necessary changes to ensure that it is accurate and kept up to date. If a member wishes to do this, please contact the Hotel via email to privacyoffice@jumeirah.com
 (c) The Hotel is entitled by law to charge a fee to meet the costs in providing a member with details of the information the Hotel holds about such member.

13. Club Opening Times
13.1. The Club is open daily for members and guests between 05.30 hours 23.00 hours, last entrance permitted at 22.30 hours.
13.2. Spa treatments are available typically between 08.00 hours to 22.00 hours. Club Members can avail discounts on spa treatments (non-transferable) as per their membership category:
 (a) Lifestyle Members qualify for thirty percent (30%) discount on spa treatments.
 (b) Sports & Fitness Members qualify for twenty five percent (25%) discount on spa treatments.
 (c) Fitness Members qualify for twenty percent (20%) discount on spa treatments.
13.3. The Club retains the right to extend or limit the opening/closing hours at its own discretion without prior notice.
13.4. Opening hours on other official holidays are at the discretion of the Management.

14. Junior Members (where applicable)
14.1. Junior members or guests members below 16 years of age are not allowed to use the indoor recreational facilities (Spa, sauna, steam room, solarium, gym, and outdoor functional fitness areas). Exception to rule only applies to junior members or guests participating in family events or personal training.
14.2. Junior Members under the age of sixteen (16) years are not allowed access to the Club without being accompanied by an adult (over eighteen (18) years) and shall not be permitted to use the gym.
14.3. For security purposes, only J-Club members are allowed to access the Kid’s Club when dropping off or collecting junior members/guests.
14.4. Parents or guardians are responsible for the behaviour of junior members in their party and should ensure that junior members under the age of five (5) years old do not use the pool or attempt to swim in the sea without adult supervision.
14.5. Junior member under the age of sixteen (16) years are not permitted to use the steam/steam rooms, jacuzzi, plunge pools or any other spa facilities where applicable.

15. Gym and Fitness Facilities
15.1. All members must complete a pre-exercise questionnaire and undergo an initial induction session before using the gym or exercise studio equipment. Members and guests are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. The Club reserves the right to refuse access to the gym and fitness facilities to any member or guest if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such facilities.
15.2. Members and their guests must notify the Club of any circumstances affecting their health which may be exacerbated through continued use of gym or fitness facilities.
15.3. If unsure, Members and their guests should not use any piece of gym equipment without prior instruction. Members and guests should ask a member of the Club’s gym team how to use new or unfamiliar equipment. The
 Club will not be liable for injuries caused by incorrect use of the same.
15.4. Access to the exercise studios is limited to classes or pre-organized sessions. Details of these will be posted on Club notice boards and will be available from the Club’s reception.
15.5. Members and guests using the gym must carry a training towel at all times for the purpose of wiping down equipment after use.
15.6. Only non-marking training shoes will be allowed within the gym, fitness studio or squash court. Members are requested to wear tops at all times.
15.7. Members are not permitted to bring personal trainers into the gym. Fully qualified personal trainers are available at the gym and may be booked at the Club reception.
16.8 In respect of local customs, please refrain from taking any photo’s or videos within the gym.

16. Facility Bookings
16.1. Advance bookings may be made for certain facilities at the Club. All bookings must be confirmed on arrival, no later than fifteen (5) minutes prior to the booked time; otherwise they will be released to the waiting list or general availability.
16.2. Seven (7) days advance bookings may be made either by telephoning the Club’s reception or in person by Members quoting their membership number. Only one squash/Tennis court booking is allowed per day per family membership. Members are not allowed to bring any personal coaches.
16.3. Facility and class fees, where applicable, must be paid before use of the relevant facility, as directed by the Club. Members are not allowed to bring any personal coaches.

17. Tournaments / Social Activities
17.1. The Club reserves the right at any time without prior notice to set aside facilities for tournaments, exhibitions or other social activities.

18. Swimming Pool
18.1. The Club requests that all members and their guests observe the following:
 (a) No running, jumping or diving is allowed in any of the pool areas;
 (b) For reasons of health and hygiene it is necessary for all members and guests to shower before entering the pool;
 (c) No balls, floats, inflatable, masks, snorkels or fins are permitted in the pool areas other than those provided by the Club;
 (d) Radios, lilos and anything which the Club, in its absolute discretion, considers to be detrimental to the use of the pool areas are not permitted;
 (e) Members and guests are requested to wear conventional swimming costumes or swim wear adhering to local customs only;
18.2. The pool areas may from time to time be reserved for adults only, swimmers only, lessons or children parties.
18.3. Children under the age of 16 years must be supervised by an adult (aged 18 years and over) when using the pool.
18.4. Toddlers must be accompanied in the pool by the parent or guardian at all times.
18.5. Swimming nappies are mandatory for children aged 4 years and under. Failure to comply with this rule will result in immediate refusal of pool entry by Club Management.

19. Saunas, Steam Rooms, Jacuzzi, Whirlpool and Solarium (where applicable)
19.1. Members and guests with the following conditions should not use the saunas, steam rooms, Jacuzzi and spa baths: low or high blood pressure, cardiac irregularities, asthma and pregnancy. Those members who suffer from diabetes, heart disease and skin disorders should consult a doctor first.
19.2. Neither the Club nor the Hotel accepts any liability for any consequential injuries or illnesses. If there is any doubt, the member or guest should consult his doctor.
19.3. Members and guests must shower before and after using the saunas, steam rooms, Jacuzzi and whirlpool. Swimming costumes must be worn in the communal sauna and steam rooms. For safety reasons no person should spend more than fifteen (15) minutes in a sauna, steam room, Jacuzzi or whirlpool. Shaving or use of soap or hair products is strictly prohibited in the saunas, steam rooms, Jacuzzi or whirlpool. Users are advised to drink plenty of water whilst using the Steam or Sauna.
19.4. Members and guests shall not use the sauna, steam room, Jacuzzi, whirlpool or solarium while under the influence of alcohol, antihistamines, beta blockers, narcotics or tranquillizers.
19.5. The drying of clothing or footwear in the sauna is strictly prohibited.

20. Lockers
20.1. Personal belongings are brought onto Club and Hotel premises at the member’s own risk and the Hotel and/or Club do not accept liability for any loss or damage whatsoever to such items. For security reasons members and guests are advised to store personal belongings and valuables in the lockers provided.
20.2 Members and Guests are required to remove all personal belongings from the lockers after their activity. The Club has the right to remove personal belongings that are left in the lockers at the end of each day. Unclaimed property shall be kept by Hotel security for a period of 1 month, after which Club Management reserves the right to dispose of the items in such way it in their entire discretion deems fit. Clothing and other similar items will be disposed of, however, any items of value will be sold periodically and all proceeds donated to the nominated charity of the Club / Hotel’s choice and no claims shall be entertained after this period from members or guests.

21. Dress Code
21.1 All members, junior members, and guests are required to dress modestly when on Club and Hotel premises.
21.2 Members should remain modestly and appropriately dressed at all times, including in the sauna, steam and changing areas.
21.3 Nudity is strictly not permitted, and members are requested to use the private changing cubicles provided.

22. Data Security
22.1 In the course of your membership, the Club and/or Hotel may collect certain personal information about you including personal details, financial details, and information about your health and person. We will use this information for purposes including managing your membership and communicating with you. You will always be given the opportunity to opt out of such communications via the website. You have the duty to keep your personal information up to date and to inform us of any significant changes.
22.2 We will limit access to the processing of and use of your personal information to our employees and management who may, from time to time, require its use for marketing or other services. In addition, from time to time, we may need to make your personal information available to third parties such as legal authorities, our group companies, and professional advisors.
22.3 We may also provide your contact information to our business partners and third parties who may contact you about their products and services. To exclude yourself from this, please email info@thejclub.com.
22.4 Please contact the manager of your Primary Club if you have any questions or concerns about how the Club and/or Hotel will use and store your personal information or if you wish to exercise your right to access, modify, object to the use of or request the deletion of your personal information.
22.5 We reserve the right to take photographs of our facilities (which may include you, provided your inclusion is incidental) for press and promotional purposes.
22.6 We will endeavour to use whatever method of communication deemed appropriate to notify you of the Club and/or Hotel information in order to best serve your experience and assume that the information provided by you is correct and an acceptable method to provide you with this information.
22.7 As part of our efforts to make further improvements to our service we provide our members, telephone calls to and from the membership support team may be recorded or monitored and used for training purposes. To protect the operation of our computer systems we monitor incoming and outgoing email.
22.8 As a member of the Club and/or Hotel, you acknowledge that you have read and understood the provisions of this paragraph and that you agree that the Club and/or Hotel may collect, use, process and disclose your personal information as described here and above.
